1. Know your supervision duties
ABA Formal Opinion 08-451 says lawyers may outsource legal and nonlegal support work. The lawyer stays responsible for competence and supervision (Model Rules 1.1, 5.1 and 5.3), must protect confidential information, and must avoid assisting unauthorized practice. Check your own state's rules and ethics opinions too.
2. The title "paralegal" in California
California defines who may be called a paralegal in Business and Professions Code §6450. The section covers work under attorney supervision, education or experience qualifications, and continuing education every two years (four hours of legal ethics plus four hours of general or specialized law). §6452 restricts using the title without meeting those qualifications. Many firms give remote hires a title such as "legal assistant" or "bilingual case assistant" unless the qualifications are met. Confirm with your ethics counsel.
3. Screen for real bilingual legal skills
- A live call in Spanish and English, such as a mock intake for an injured worker
- A written test: summarize a Spanish medical note in English
- Familiarity with your case management software, or quick learning in a paid trial task
- References, plus confidentiality and conflicts acknowledgments
4. Choose how to employ and pay
Options: an independent contractor agreement (classification risk depends on local law), an Employer of Record, or a staffing partner who recruits, employs and supervises day to day while you direct the legal work. Get local legal and tax advice for the worker's country.
5. Lock down data access
Use firm-managed accounts with MFA, least-privilege access in your case management system, no client files on personal devices, and an offboarding checklist that removes access the same day.

Can a remote paralegal abroad talk to my clients?
Generally yes, for non-advice tasks under your supervision. Tell clients who is working on their matter, never let the assistant give legal advice, and check your state's rules.
Is a contractor cheaper than an EOR?
Usually on fees, but an EOR takes on local employment compliance. The right choice depends on hours, control and local law.
